Overview of the Workers Compensation Claim Settlement
Compensation laws, such as the Workers Compensation Acts, are created to ensure that employees harmed or injured while on the job are given rightful financial support to eliminate litigation. Federal Jones Act
Another type of compensation law is the Federal Jones Act, which provides seamen with the same FELA compensations for railroad workers. Negligence on the part of the employer, which causes harm or injury to a sailor, is ground for compensation. The sailor can also sue other parties who may be involved in the incident.
Aside from FELA and the Federal Jones Act, there are two other types of Worker Compensation Acts called: Black Lung Benefit Act for miners and the Longshore and Harbor Worker Compensation Act or LHWCA for employees of private maritime employers.
Negotiating a Settlement
The first thing you need to do is to report the injury to your employer and fill out an incident report as soon as possible. After recounting the events that led to the accident, remember to consult your doctor. The doctor has the task of documenting the injuries and providing you with the necessary information for rehabilitation.
In order to know the expected expenses and compensation for the period of rehabilitation, refer to the diagnosis made by the doctor. The monetary award you shall receive should be at least the amount you are willing to accept although you can still negotiate for a larger amount.
